Welcome to WildDeck. Please read these Terms of Service carefully before using our application. By accessing or using WildDeck, you agree to be bound by these terms.
By downloading, installing, or using the WildDeck mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you and WildDeck Ltd, a company incorporated and registered in Scotland under the Companies Act 2006 (Company Number: SC880737) ("we", "our", "us"). We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.
You must be at least 13 years of age to use WildDeck. If you are under 18, you must have permission from a parent or legal guardian who agrees to these Terms on your behalf. By using the App, you represent and warrant that you meet the eligibility requirements and have the right, authority, and capacity to agree to and abide by these Terms.
To access certain features of the App, you must create an account. You agree to: • Provide accurate, current, and complete information during registration. • Maintain the security and confidentiality of your login credentials. • Accept responsibility for all activities that occur under your account. • Notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
WildDeck grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, in accordance with the laws of Scotland and the United Kingdom. You agree not to: • Use the App for any unlawful purpose or in violation of any applicable laws, including the Computer Misuse Act 1990. • Upload or share content that is offensive, harmful, threatening, abusive, defamatory, or otherwise objectionable. • Use fraudulent or misleading images to unlock wildlife cards. • Attempt to gain unauthorised access to other users' accounts or our systems. • Reverse-engineer, decompile, or disassemble any part of the App. • Use bots, scripts, or automated methods to interact with the App. • Interfere with or disrupt the integrity or performance of the App.
The wildlife identification feature uses artificial intelligence and is provided for entertainment and educational purposes only. While we strive for accuracy: • We do not guarantee that all identifications are correct. • You should not rely solely on the App for species identification in safety-critical situations. • Always exercise caution around wildlife and follow local guidelines, including the Wildlife and Countryside Act 1981 and the Nature Conservation (Scotland) Act 2004. • Photos submitted for identification are processed in accordance with our Privacy Policy.
You retain ownership of photos and content you upload to WildDeck. By uploading content, you grant us a worldwide, non-exclusive, royalty-free licence to use, process, and display your content within the App for the purposes of providing our services. You are solely responsible for the content you upload and must ensure it does not infringe on any third party's intellectual property or other rights. We reserve the right to remove content that violates these Terms. Profile pictures must be appropriate and not contain offensive, explicit, or misleading content. We reserve the right to remove inappropriate profile images and suspend accounts that repeatedly violate this policy.
WildDeck offers in-app purchases including virtual coins, premium subscriptions, and physical card orders. • Virtual coins have no real-world monetary value and cannot be exchanged for cash. • All in-app purchases are processed through the App Store (iOS) or Google Play Store (Android) and are subject to their respective terms and refund policies. • Premium subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. • We reserve the right to modify pricing, coin values, and available items at any time. • Virtual items and currencies may be modified, removed, or reset at our discretion.
Physical card printing and delivery services are available to users in the United Kingdom. By placing an order: • You agree to provide an accurate delivery address. • Delivery times are estimates and not guaranteed. • Physical cards are printed by third-party partners and are subject to their quality standards. • Refunds and returns are handled in accordance with the Consumer Rights Act 2015 and applicable UK consumer rights legislation. • You have a statutory right to cancel orders for physical goods within 14 days of receipt under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. • We are not responsible for delays caused by Royal Mail, postal services, or third-party delivery providers.
Battle features involve wagering virtual coins against AI opponents or other players. By participating: • You accept that battle outcomes are determined by game mechanics including card stats, abilities, and random elements. • Virtual coins wagered and lost cannot be recovered. • We reserve the right to modify battle mechanics, entry fees, and reward structures. • Any form of cheating, exploiting bugs, or manipulating battle outcomes is strictly prohibited and may result in account suspension. • Virtual coin battles do not constitute gambling under the Gambling Act 2005 as virtual coins hold no real-world monetary value.
We encourage users to report violations of these Terms, including: • Offensive or inappropriate profile pictures. • Use of non-authentic images to unlock wildlife cards. • Cheating or exploitative behaviour in battles. • Any other conduct that violates these Terms. Reports can be submitted via the App or by emailing info@wild-deck.com. We will review reports and take appropriate action, which may include warnings, content removal, or account suspension.
All content, features, and functionality of WildDeck — including but not limited to text, graphics, logos, icons, images, audio, software, and the overall design — are owned by WildDeck Ltd and are protected by the Copyright, Designs and Patents Act 1988, the Trade Marks Act 1994, and other applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, or publicly display any part of the App without our prior written consent.
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law: • We do not warrant that the App will be uninterrupted, error-free, or secure. • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. • Our total liability shall not exceed the amount you have paid to us in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under the laws of Scotland and England & Wales, including your statutory rights under the Consumer Rights Act 2015.
We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination: • Your licence to use the App is immediately revoked. • You may lose access to your account, collection, virtual currency, and any purchased items. • Provisions of these Terms that by their nature should survive termination will remain in effect.
We encourage you to contact us first to resolve any disputes informally by emailing info@wild-deck.com. If If a dispute cannot be resolved informally, you may also use the European Commission's Online Dispute Resolution (ODR) platform or seek resolution through an Alternative Dispute Resolution (ADR) provider approved by the Chartered Trading Standards Institute (CTSI).
These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the Scottish courts. If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
